South Dakota marijuana loses in court

PIERRE, SD (KELO-AM) Medical Marijuana will not be on the November ballot in South Dakota.

Circuit Court Judge Mark Barnett sided with the South Dakota Secretary of State who rejected the initiated measure due to insufficient petition signatures.

Primary sponsor of the cannabis measure, Melissa Mentele, claimed she did not recieve sufficient notice of the rejection from the Secretary of State so the measure should be allowed on the ballot. The judge ruled that she had received proper notice.

The marijuana measure would have allowed up to three ounces of pot to be possessed by a patient with a serious medical condition.

State Attorney General Marty Jackley reacted to Tuesday's court decision.

" Today’s decision affirms the hard work Secretary of State Shantel Krebs and her Office put into ensuring the integrity of our election process,” 

Mentele posted on Facebook that she thanked everyone for their positive thoughts, love and prayers. She said that she was "currently regrouping" and would post when she had more information.
