Extended vacancy on Supreme Court

SIOUX FALLS, S.D. (KELO AM) - The US Supreme Court sits stalled at eight members and some Republican senators say they'll wait until next year to consider confirmation, maybe longer if Hillary Clinton is elected

Senator John Thune says talk of a potential nominee is pure speculation.

Thune says what he's hearing per se is that Clinton, if elected, would no continue on with the nominee that President Obama would put forward with Judge Merrick Garland.  Chief Judge Merrick Garland was confirmed to the D.C. Circuit Court

Thune says Republican senators have standards when considering the next Supreme Court justice.

South Dakota's senior Senator says he hopes the nominees that either winner puts forward will respect the Constitution and the law, and not try activists by legislating from the bench.

Texas Senator Ted Cruz thinks it would be fine if the U.S. Supreme Court, down to eight since Antonin Scalia died in February, continued working with only eight justices.

Garland was nominated by President Obama on March 16, over 230 days ago.
