UNDATED (WTAQ) - It remains unclear when Brendan Dassey might get his supervised release from prison after Monday's order by a federal magistrate judge.
Attorneys for Dassey were expected to file residency request paperwork by noon Tuesday, which was the deadline set forth by U.S. Magistrate Judge William Duffin. Dassey had to provide the federal probation and parole office the address of his intended residence upon release.
Tuesday afternoon, the Wisconsin Department of Justice filed paperwork with its arguments for the judge to stay Dassey's release. They requested Duffin to make a decision on its motion by 4 p.m. Wednesday.
FOX 11 reports that the Wisconsin Eastern Probation Office didn't return calls for information about the paperwork from Dassey's team.
A statement posted on the website for the Center on Wrongful Convictions of Youth, who's representing Dassey, said:
"Brendan's team is unable to respond to media inquiries at present but will take steps to answer those inquiries at an appropriate time. Please continue to visit www.cwcy.org for updates."
Wisconsin Attorney General Brad Schimel also says they will file an emergency motion with the 7th U.S. Circuit Court of Appeals by the end of Wednesday.
Duffin, who previously overturned Dassey's conviction for the 2005 murder of Teresa Halbach, now says Dassey should be released from prison while the state appeals the overturning. The judge ruled in August that investigators tricked Dassey into confessing he helped his uncle, Steven Avery, rape, kill and mutilate Halbach. The state has appealed that ruling.
Where could Dassey live while the rest of the case plays out?
In a September filing, Dassey's attorneys said he would spend the initial 1 to 3 months living in a family-owned trailer with his mother about 100 miles from Manitowoc. Then he would move to an apartment in Brown County so he could participate in educational, vocational and therapeutic services in the area.
On Monday, Dassey's attorneys said they hope Dassey is released by Thanksgiving.
