PIERRE, SD (KELO-AM) South Dakota plans to join the legal challenge against President Obama's transgender bathroom directive.
South Dakota will join 11 other states fighting the Obama Administration's order to all public schools in the country that transgender students must be allowed to use the bathrooms and locker rooms of their choice.
"The President's attempt to require children of opposite sex to share locker rooms and bathrooms under the threat of lawsuit and witholding of education funding," Jackley says, "is a one size fits all solution that goes beyond his constitutional authority."
Jackley says that it's his contention that federal law cannot direct local school districts on who can use a bathroom.
"These issues need to be handled as they have been for a long time - on the state and local level," says Jackley.
